By downloading, installing, or using Prompt Genie ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Prompt Genie is an AI-powered writing assistant that helps users create content using Claude 3.5 Haiku AI technology. The App provides:

• 80+ ready-to-use prompts for various writing tasks
• AI-generated content based on user inputs
• Personalization features using user-provided data
• History and favorites management
• Multi-language support

3. User Accounts and Registration

The App does not require user registration or account creation. All data is stored locally on your device.

4. Credits and Purchases

4.1 Credit System

The App uses a credit-based system where:

• Each AI generation costs 1 credit
• Credits never expire
• Credits work with all available prompts
• New users receive 3 free credits upon first launch

4.2 In-App Purchases

You can purchase additional credits through Apple's In-App Purchase system:

• Starter Pack: 100 credits - $2.99
• Popular Pack: 300 credits - $7.99
• Pro Pack: 1000 credits - $19.99

All purchases are final and non-refundable except as required by applicable law or Apple's refund policy.

4.3 Pricing

Prices are displayed in your local currency and may vary by region. Prices are subject to change without notice, but changes will not affect credits already purchased.

4.4 Refunds

All purchases are processed through Apple's App Store. For refund requests, please contact Apple Support directly or visit your purchase history in the App Store.

5. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App to generate illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Attempt to circumvent the credit system or exploit the App
• Reverse engineer, decompile, or disassemble the App
• Use the App to spam, phish, or engage in fraudulent activities
• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Use the App to generate content that violates third-party terms of service

6. Content and Intellectual Property

6.1 Your Content

You retain all rights to the content you input into the App and the content generated by the AI. You are solely responsible for:

• The legality and appropriateness of your inputs
• How you use the generated content
• Ensuring your use complies with applicable laws

6.2 AI-Generated Content

AI-generated content is provided as-is. While we strive for accuracy and quality:

• Content may contain errors or inaccuracies
• Content should be reviewed and edited before use
• We make no warranties about the suitability of generated content for any purpose
• You are responsible for verifying facts and ensuring appropriateness

6.3 App Content

The App, including its design, prompts, features, and functionality, is owned by us and protected by copyright and other intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content
• Use our trademarks, logos, or branding without permission
• Create derivative works based on the App

7. Third-Party Services

7.1 Claude AI

The App uses Anthropic's Claude AI API to generate content. Your use of AI features is subject to Anthropic's terms of service and privacy policy.

7.2 Apple Services

In-app purchases are processed through Apple's App Store, subject to Apple's terms and conditions.

7.3 No Endorsement

We do not endorse or guarantee any third-party services, and we are not responsible for their actions or content.

8. Disclaimers and Limitations of Liability

8.1 No Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or quality of generated content
• Warranties of uninterrupted or error-free operation

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from your use or inability to use the App
• Damages resulting from AI-generated content
• Any claims exceeding the amount you paid for credits in the past 12 months

8.3 AI Limitations

You acknowledge that AI-generated content:

• May be inaccurate, incomplete, or inappropriate
• Should not be used as professional, legal, medical, or financial advice
• Requires human review and verification
• May not be suitable for all purposes

9. Indemnification

You agree to indemnify and hold harmless Prompt Genie and its affiliates from any claims, losses, damages, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of others
• Content you generate or share using the App

10. Termination

We reserve the right to:

• Suspend or terminate your access to the App at any time for any reason
• Modify or discontinue the App or any features
• Remove or refuse to generate any content

Upon termination, you must cease all use of the App. Provisions regarding intellectual property, disclaimers, and limitations of liability survive termination.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting updated Terms with a new "Last updated" date
• In-app notification for significant changes

Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or the App should first be addressed through good-faith negotiation. If unresolved, disputes shall be handled according to applicable law in your jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prompt Genie regarding the App.
